Overflow gasket issues

I just reinstalled a garden tub in my house, but the overflow gasket doesn’t have a tight seal on the top causing leaking when the water gets to the top 1.5 inches of the overflow drain, I can put my finger in there and move the gasket around. What is the best way to fix this? If I could find an overflow gasket that isn’t tapered I’m pretty sure that would work, but I have not been able to find one. My current thoughts are one of the following:
1. Put two gaskets together with the tapper on opposite sides, or
2. Use silicon to seal around the top
Any better recommendations or thoughts?

It sounds like you have the gasket in upside down. Most tubs aren't straight and require a tapered gasket. There are gaskets that are made of a softer foam type rubber that may fit the shape of your tub better.

The gasket isn't upside down, as I said, it is leaking from the top, and I can move the top around. If it was upside down it would leak from the bottom.

I have tried both the soft gaskets and harder ones, with no luck.
 
Leaking from the top tells me that the gasket is to thick at the bottom not allowing the top to come in contact with the tub. Maybe a picture would help.

If you have the tubular compression style tub waste, turn the overflow gasket so the taper is to the sides, then tighten the overflow back down to twist the overflow so that the gasket contacts evenly all the way around.
