Is this a toilet overflow or backflow?

Trying to figure out what happened in an apartment, we know the water came from the toilet but did is it raw sewage or not?

The toilet water is now turned off but the water in the bowl is yellow and no one has used it.

The toilet flowed water for several hour and soaked the entire apartment and it now definitely smells strongly like sewage.

Visible feces were seen around on the carpet.

And there is construction going on outside.

The landlord is trying to say that it is not raw sewage.

If it came from the toilet it was sewerage,is this a basement apartment, ,this there a drain pipe exposed so a (backwater valve)could be installed,were they working on the sewer??????

It not a basement but it is the lowest floor, it actually has two bathrooms but only one toilet overflowed.

I don't know about the drain pipe.

Is there a way to prove that it was sewage? There are people living in the apartment and they are all sick now even the dog is sick.
 
Just have the air tested or what's in the toilet or in the floor/rug,any professional cleaning co can tell you what it is,you would need an air testing co to verify the air findings,the cleaning could help you with what's in the rug or the floor , your city or town, could test the questionable water

If there are toilets above you, then the main was plugged and the wastes from the above showers, sinks, and toilets overflowed from your toilet. The construction could have been the cause, or the line simply became plugged downstream of your connection to the sewer.
